A BILL to amend article one, chapter five-f of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section five,
relating to reconfirmation of secretaries and commissioners
by the Senate two years after initial appointment with
advice and consent of the Senate.
Be it enacted by the Legislature of West Virginia:
That article one, chapter five-f of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
five, to read as follows:
ARTICLE 1. GENERAL PROVISIONS.
§5F-1-5. Reconfirmation of secretaries and commissioners by the
Senate.
In addition to provisions elsewhere in this code requiring
that various positions are to be filled by appointment by the
governor by and with the advice and consent of the Senate, those
administrators designated as secretaries who head departments
listed in section two, article one, chapter five-f of this code,
and those appointed administrators designated as commissioners
who head agencies of the state government, in order to continue
serving in their appointed positions, shall be reconfirmed by
the Senate for continuing appointment two years after their
initial appointment.
NOTE:
The purpose of this bill is to
require heads of major
agencies, initially appointed with advice and consent of the
Senate, to be reconfirmed by the Senate two years after their
initial appointments.
